As it stands, and despite the lack of appellate authority on the matter, the County Courts are becoming more and more used to dealing with allegations of fundamental dishonesty in personal injury cases, and specifically within the context of qualified one way costs shifting.

This book aims to illustrate the the development of the concept so far, and by drawing on decisions from across the country provides practical guidance as to what fundamental dishonesty means, the purpose of it's inclusion within CPR 44, as well as and pitfalls to look out for and to avoid.
