Details

The original purpose for A Student’s Guide to Hong Kong Conveyancing was to provide law students with a comprehensive exposition of the relevant conveyancing courses being conducted at Hong Kong tertiary institutions. It has, however, reached an audience much wider than the student population. For many decades, land law in Hong Kong has followed traditional principles while taking into consideration the different conveyancing practices and circumstances relevant to Hong Kong. It is now discernible that land law and conveyancing are adopting an approach that represents a genuine merger of overseas principles with local law – a trend that will become clearer still if and when land titles legislation is adopted. For now, the book seeks to describe the way in which the common law, equity and statutes deal with land and land transactions in Hong Kong.

The fifth edition contains an extensive and detailed body of Hong Kong case law. The scale of local case law explaining and developing conveyancing in Hong Kong is now vast, and no conveyancing solicitor can afford to neglect the ever more complex system that applies. The Court of Final Appeal has considered and determined many important issues and, at least in some areas, certainty has been achieved. However, many points of contention still remain, and it is one aim of this book to report, discuss and shed some light on those issues.

A Student’s Guide to Hong Kong Conveyancing is essential for students of land law and conveyancing at all stages. It is widely adopted at tertiary level and is used as the conveyancing text for the Overseas Lawyers Qualification Examination (OLQE).
