This book describes and evaluates the common law rules of evidence in each Australian jurisdiction as well as statutory changes made by the State and Territory Evidence Acts and the 'uniform' evidence legislation - the Evidence Act 1995 (Cth), the Evidence Act 1995 (NSW) and the Evidence Act 2001 (Tas). The text also provides instruction on how to use those rules in solving practical problems. Questions are asked in each chapter with a view to directing law students to the operation of the rules in their practical context. This new edition is particularly valuable in the context of the recent proposed reform of the law of evidence discussed by the Australian Law Reform Commission in its review of the Evidence Act 1995 (Cth) released in July 2005.
