Costs & Funding following the Civil Justice Reforms: Questions & Answers is a unique book. Produced in conjunction with Practical Law, this practical and accessible book tackles common practitioner questions on the effects of the 2013 Jackson reforms on costs and funding. It not only states the law, as set out in the latest legislation, court rules, forms and case law, but also identifies and, where possible, tackles issues and inconsistencies. It sets out to answer questions posed on topics ranging from funding of litigation, case and costs management and proportionality to settlement offers, QOCS and summary assessment. Each chapter starts with introductory commentary covering relevant legislation, case law and Lord Justice Jackson’s Review of Civil Litigation Costs: Final Report followed by the questions and answers, sub-divided under topics. The new edition includes coverage of changes made by recent CPR and legislation updates, including various changes to the CPR as a result of the CPRC’s simplification initiative such as the relocation of the costs management PD from PD 3E to PD 3D (152nd CPR update) and changes as a result of the substantial revision to the Chancery Guide in July 2022 and subsequent revision in October 2022.

The book covers other new important developments such as the proposed changes to the CPR rules on QOCS, the moves towards the extension of the fixed recoverable costs regime, and the Civil Justice Council’s holistic and strategic review of costs launched in July 2022.
