The Criminal Justice and Immigration Act 2008 introduces important new provisions that affect current practice. This thorough yet concise guide provides an analysis of the provisions with clear explanations of how the law will work in practice, making reference to appropriate cases, and new and existing legislative provisions as necessary.

The Act builds on the already considerable reforms made over the past ten years to the Criminal Justice System. It includes measures to:

  • allow Courts to make dangerous offenders serve a higher proportion of their tariff before being eligible for parole
  • change the rules relating to bail and allocation of offences
  • extend powers relating to anti-social behaviour orders
  • create new offences of: possession of extreme pornography, causing a nuisance or disturbance on NHS premises, and incitement to hatred on ground of sexual orientation
  • introduce Violent Offender Orders, allowing courts to impose post-sentence restrictions on those convicted of violent offences
  • introduce Youth Rehabilitation Orders and Youth Conditional Cautions
  • enable a new special immigration status for terrorists and serious criminals who cannot be currently removed from the UK.

About the Author

Angela Burns is a solicitor (non-practising) and senior lecturer on the Legal Practice Course at The City Law School, City University, London. Angela practised criminal defence at Ben Hoare Bell solicitors, Sunderland prior to moving into legal education. She is the programme director for the LPC LLM, deputy course director on the LPC and LPC co-ordinator for criminal litigation and advanced criminal practice. She also teaches practical legal research, business law and family law.

Nikki Walsh is a lecturer on the Bar Vocational Course at The City Law School, City University, London. Nikki qualified as a solicitor and practised criminal defence at Taylor Nichol solicitors, London before being engaged as a legal assistant at the UN war crimes tribunal for Former Yugoslavia in the Hague and later at the Special Court in Sierra Leone. She is the BVC deputy co-ordinator for criminal litigation, and also teaches criminal evidence, advocacy and employment law.
