Details

This book discusses the current state of the non-Muslim family law in Singapore. It covers the legal regulation of marriage, the relationship between the husband and wife, the relationship between parents and their children, the termination of marriage, the provision of maintenance among family members, the determination of property interests between family members and the orders a court may make upon ordering the termination of marriage including the division of matrimonial assets, the provision of maintenance for the former wife and orders relating to the upbringing and maintenance of the children of the marriage.

It also briefly discusses the relationship between the general non-Muslim family law and the exceptional Muslim family law as well as that between the civil courts that apply the non-Muslim law and the Syariah Court that applies the Muslim law. Interpersonal conflicts that have arisen before the courts are also briefly discussed. The family law must be carefully moulded to suit the conditions of family life in Singapore. It should ideally espouse the common values of Singaporeans.

While the law in Singapore was originally modelled on the prevailing law in England and all communities share the common aspiration to support the continuance of family relationships and promote family values, details as to what constitutes ideal legal regulation do vary between countries. It is hoped that this book contributes to the uniquely Singaporean jurisprudence.
