European Migration Law

This title provides a comprehensive overview of European migration law. The work consists of two parts. In the first part, Thym provides an analysis of the general framework behind the EU rules of migration and how these are distinguished from the constitutional rules governing the free movement of European Union citizens. Central to this part is a discussion on the significance of human rights in immigration policy-making and the role that the European Convention on Human Rights and other international instruments play in the protection of migrant and asylum rights. In the second part of the book, Thym explores the substance of EU migration law approached through a thematic, rather than chronological, lens. These chapters focus on the legislation surrounding entry into EU territory, border controls on land and sea, and the human rights component of illegal migration and asylum.
