The Civil Justice (Miscellaneous Amendments) Ordinance 2008, enacted in February 2008, is the first step in implementing Civil Justice Reform in Hong Kong. As acknowledged by the Steering Committee on Civil Justice Reform, the 2008 Ordinance implements some of the key recommendations set out in the Final Report of the Chief Justice's Working Party on Civil Justice Reform. These changes will fundamentally alter the civil litigation landscape in Hong Kong.

Examples of the changes include:

§ the introduction of a leave to appeal requirement for interlocutory appeals;

§ cost-only proceedings;

§ extension of pre-action disclosure by non-parties to all cases (not only personal injury and death cases); and

§ the jurisdiction to grant Mareva injunctions as independent relief in aid of foreign proceedings.
