    Since the publication of the Second Edition of The Hong Kong Personal Insolvency Manual in 2010 and the Fourth Edition of its companion volume, The Hong Kong Corporate Insolvency Manual in 2018, there have been significant developments in the personal insolvency law and practice in Hong Kong. This Third Edition of The Hong Kong Personal Insolvency Manual addresses personal insolvency law developments and updates the discussion of case law and legislative enactments. It will be a valuable resource for accounting and legal professionals working in the insolvency field, as well as for bankers, academics and university students.

     

    Extensive expansion of Chapter 1, ‘Introduction to Personal Insolvency in Hong Kong,’ including much more data about Hong Kong personal insolvency law;

    • Identification of a dramatic increase in the number of convictions for bankrupts committing offenses under BO, ss 43A, 129 and 134. (Chapter 1);

    • Examination of how the court handles bankruptcy petitions with reference to the practice directions established by the Hong Kong Judiciary (Chapter 6);
    • Discussion of how trustees in bankruptcy administer the finances of the bankruptcy estate under the scrutiny of the ORO (Chapter 7); and
    • Exploration of a developing regime of bankruptcy litigation in Hong Kong in which trustees in bankruptcy commence order for sale proceedings against landed properties in Hong Kong originally co-owned by the bankrupt and a solvent co-owner in an attempt to benefit the bankruptcy estate (Chapter 9).
  • Charles D Booth

    Professor Booth (BA, Yale University, 1981, summa cum laude; JD Harvard Law School, 1984, cum laude) is a Professor of Law at the William S. Richardson School of Law at the University of Hawai‘i and the Founding Director of the Institute of Asian-Pacific Business Law (IAPBL). He taught in the Faculty of Law at the University of Hong Kong from 1989 to 2005, where he also served as the Director of the Asian Institute of International Financial Law (AIIFL) from 2000-2005. He is also a Senior Advisor at Burford Capital.

    MA (Oxon); Barrister, Lincoln's Inn and Hong Kong; Barrister and Solicitor of the Supreme Court of Tasmania and the High and Federal Courts of Australia; Department of Justice; formerly Professor, School of Law, City University of Hong Kong and District Judge Hong Kong; Senior Assistant Law Officer, Commercial III (Companies Ordinance Rewrite Team), Department of Justice, HKSARG.Professor Tyler came to Hong Kong in 1985 from Australia. He was a professor at The University of Hong Kong from 1985 to 1991, when he became a District Court Judge. He returned to academia in 1994 to City University of Hong Kong and retired from there back to Australia in 2005. In 2007 he returned to Hong Kong to a temporary position in the Commercial Unit, Civil Division, Department of Justice working on the Companies Ordinance Rewrite (The new Companies Ordinance was passed in July 2012). He is now working on the Improvement of Corporate Insolvency Law exercise. Professor Tyler has lectured and written on Hong Kong Company Law for the past 25 years.
