The IDS Employment Law Handbook Practice and Procedure II: Employment Appeals Tribunal 2023 is an essential guide for those involved in cases before the Employment Appeal Tribunal in England and Wales and in Scotland. It explains clearly and in detail how appeals are instituted, processed and heard. Topics covered in depth in this Handbook include the judicial composition of the EAT; its appellate jurisdiction and potential grounds of appeal; the procedure for instituting an appeal and the documents required to be supplied; the time limit that applies to the lodging of an appeal and the circumstances in which it may be extended; the sift, preliminary hearings and case management; the rules governing the admission of evidence before the EAT; the format of EAT hearings, including the provision for remote hearings; and the circumstances in which costs may be awarded against a party.

The previous edition of this Handbook, Employment Tribunal Practice and Procedure 2018, covered practice and procedure in the EAT as well as in the employment tribunal. The separation of these topics into two Handbooks reflects the ever-increasing volume of case law and guidance in this area, and the fact that practice in the two different forums is distinct. Among other things, the Employment Tribunal Handbook includes a new chapter on deposit orders and striking out, as well as new sections on remote hearings and digitisation, while this EAT Handbook covers the detailed Practice Direction governing EAT procedure issued in September 2023.
