The book examines the law and practice of marine cargo insurance on a worldwide basis and provides the busy practitioner with the law and materials necessary to resolve quickly and accurately cargo insurance coverage issues that arise in his/her own jurisdiction and in other countries.

Jurisdictions covered

It concentrates on the law in England and the United States, and also examines other countries with a common law tradition including Hong Kong, Singapore, Japan, and Australia. The civil law systems are highlighted in a number of key trading nations: Italy, Germany, France and Norway. The book includes chapters on South Africa as well as the People's Republic of China. It concludes with a comparative law chapter concentrating on issues that arise in practice in cargo coverage cases. This chapter also examines how the Institute Cargo Clauses have been construed by courts worldwide. There is an international analysis of jurisdiction and applicable law following which the chapters for each country include a consideration of:

  • The standard cargo policy conditions

  • The approach to exclusions, such as inherent vice

The appendices include standard cargo policy insurance terms used in each jurisdiction, some translated for the first time for this volume, as well as translations of the relevant statutes and commercial codes, many not available elsewhere.

The book is a companion volume to Marine Cargo Insurance (Informa 2009) winner of the 2010 British Insurance Law Association's book prize, also in the Lloyd's Shipping Law Library.

About the Author

John Dunt is a Consultant with Clyde & Co and also a Senior Research Fellow at the Institute of Maritime Law, University of Southampton. He qualified as a solicitor in 1972 and joined Clyde & Co in 1975. He was a partner for 30 years from 1977 to 2007 specialising in marine insurance, with particular reference to cargo insurance.

John was ex-officio legal advisor to the Joint Cargo Committee from December 1999 to April 2007 and was involved in drafting the wordings used in marine cargo insurance policies worldwide to control terrorism risks. He was also a member of the Joint cargo Committee Working Party responsible for updating and revising the Institute Cargo Clauses 2009. He currently sits with the Lloyd's Market Association Steering Group overseeing the revisions to the Institute Trade and Commodity Clauses.

John Dunt is author of Marine Cargo Insurance (winner of the 2010 British Insurance Law Association prize) published by Informa in August 2009 as part of the Lloyd’s Shipping Law Library.
