Details

Dr Gordon Cruden in this third edition of Land Compensation and Valuation Law in Hong Kong comprehensively updates and expands the last edition published 10 years ago. During that past decade, the legislature has continued to enact a variety of important property related ordinances generating widespread case law. This legislation has required new chapters on compulsory resumption of land for urban renewal, compulsory purchase by majority owners of minority shares, government rent and the environment. A new chapter extends the analysis of pollution, drainage and sewage legislation to the Environment Impact Assessment Ordinance. Victoria harbour legislation and landmark case law is included in an expanded reclamations chapter. Complex rating disputes having become even more important since 1997 under the Government Rent (Assessment and Collection) Ordinance are dealt with in depth. Ten years of judicial interpretation of the Basic Law is reviewed in the Constitutional chapter.

Dr Cruden deals with important judgments including those of the Court of Final Appeal in Agrila on rating and government rent, Yin Shuen on development compensation, Raider on user restrictions, Capital Well on compulsory purchase by majority owners, Shui Wing Steel on environment impact assessments and Step In on pollution.

Land Compensation and Valuation Law in Hong Kong during the past 10 years has in civil litigation been the most cited Hong Kong law textbook. The courts have referred to previous editions as a seminal work. This new edition maintains and is likely to enhance the high quality of the previous editions.
