Details

Offers a practical explanation of the law, dealing with issues such as the classification of common land and rights of common and the registration of common land and rights of common.

Common land and town and village greens have value for a number of reasons – ecological, historical, agricultural, sporting or recreational. The Law of Commons and of Town and Village Greens offers a practical explanation of the law, dealing with issues such as the classification of common land and rights of common and the registration of common land and rights of common.
This edition takes account of the Commons Act 2006, which makes significant changes to the regulation and protection of common land. The Act will:
  • improve the current registration system to provide conclusive evidence of the status of common land
  • prevent severance of registered right from the land to which it is attached
  • enable the establishment of statutory commons councils with powers to regulate grazing and other agricultural activities
  • reinforce existing protections against unauthorised works and development
  • clarify the registration of town and village greens in the light of recent court decisions
This book is an invaluable reference for barristers and solicitors specialising in agricultural, planning, environmental or general property law. It will also be of interest to surveyors and local authorities.
