Details

The radical overhaul to costs and funding introduced by the Jackson reforms in April 2013 has impacted all litigators. Litigation Funding Handbook is a comprehensive guide to these extensive changes and examines the various types of funding agreements available, explains their format and use, and looks at the advantages and disadvantages of each.

This practical handbook includes:

  • the introduction of damages-based agreements (DBAs)
  • changes to Part 36 (offers to settle) to encourage early settlement
  • costs budgeting and management
  • the introduction of 'qualified one way costs shifting' in PI cases
  • CFAs as well as ATE and BTE insurance
  • third party funding arrangements.

Written by leading experts, Litigation Funding Handbook takes an in-depth and authoritative look at some of the most fundamental and far-reaching changes to funding and costs management. The handbook's expert authors set out the issues practitioners need to consider, anticipate how the Courts will deal with the many unresolved issues arising from the reforms and set out solutions. This user friendly guide also includes useful litigation funding tables and model DBAs for both solicitors and barristers. Essential reading for everyone involved in civil litigation in the new post-Jackson world.
