Section 11 of the Patents Act 1983 states that an invention is patentable if it is new, if it involves an intentive step and is industrially applicable. Such an invention is defined under section 12 of the same Act to mean the idea of an inventor which permits in practice the solution to a specific problem in the field of technology. 

Critics of software and business method patents need to know what patents are, how they work, and the cases that define the scope of what can be patented. The critics must also be informed of the procedures for the grant of patents and its duration.
