This book looks at the operational and legal functionality of a Bill of Rights in protecting human rights. It explores both the potential and the limitations of the Hong Kong Bill by drawing upon the experience of other countries, including Canada, India, the Philippines, Australia and China.
 
The background and impact of the Hong Kong Bill of Rights in its early days of operation are examined. Sources of human rights law, principles and techniques of interpretation and approaches towards limitation and derogation clauses are discussed. The roles of the judiciary, non-governmental organisations and human rights commissions in implementing and enforcing a Bill of Rights are reviewed. The impact of the Bill on discrimination, freedom of expression, the criminal justice system and family law is also assessed.
 
Contributors to this book are distinguished experts in the field and include five Supreme Court judges, two former Attorneys General and a former member of the United Nations Human Rights Committee. Although written in the context of Hong Kong, this book is relevant to other jurisdictions in which a Bill of Rights has been adopted or discussed.
