The Oxford Handbook of Digital Constitutionalism presents a comprehensive collection of contributions from international scholars who analyse the challenges of constitutionalism in the digital age. It focuses on the impact of digital technologies on constitutionalism and examines how constitutional rights and guarantees, traditionally enjoyed in the relationship between the individual and the state, are shaped by the new system of powers characteristic of the ‘algorithmic society’. This societal background sees power increasingly shared between states, societal organisations, and business actors and where algorithms and AI agents are employed by both public and private actors. In this context, the Handbook aims to capture the shift in the way power is exercised and rights are protected, as well as the transformation of related enforcement mechanisms and remedies.

Divided into four parts, it reframes constitutionalism in the digital age, analyses interdisciplinary approaches, addresses rights protection and power limitations, and offers insights into digital constitutionalism across legal systems worldwide. The Handbook provides a comprehensive overview of the role of constitutionalism in the digital age.
