Trade Marks Law in Malaysia is at a crossroad. Whilst the traditional demarcation between Part A and Part B marks of the register has been removed in 2000, the traditional conception of registrable marks is still being retained. This is by far more conservative than the current position in other countries, such as the United Kingdom, US and Japan that have opened up to other distinctive signs, be it 3D marks, shapes and features of products, single colour, smell, etc.

In this book, the author has provided a collection of the interpretation and applications of these rules by the courts in leading cases on the subject. The author has also added her commentary and analysis on the said cases, highlighting the important principles and comparing them with other cases on the issue.
