Details

Insurance is required in any purchase, sale or lease of property by various parties to protect their interests. This book provides property practitioners with a clear and concise outline of the general law of insurance, the contract, the principles of reinstatement and subrogation, and includes a wide-ranging review of:

  • the main property insurance risks;
  • other risks relevant to certain property (e.g. defective title)
  • insurances on construction and development.

The author also demonstrates in dedicated chapters how these risks apply in transactions involving freehold, leasehold, commonhold and new property and highlights the possible pitfalls which may arise from insurers' common exclusions and conditions.

Practitioners will benefit from references to the case law, a full case study on reinstatement, a series of useful precedents, extracts from standard documents including the CML Lenders' Handbook, and the relevant professional rules for solicitors.
