Details

This book outlines the principles behind the international law of foreign investment. The main focus is on the law governed by bilateral and multilateral investment treaties. Legal principles are not discussed in an abstract way but are fully illustrated by many case examples that immediately follow. Particular consideration is given to an in-depth analysis of many important arbitral awards to produce summary of the essential facts and reason for decision of various ICSID, PCA and ad hoc investor state arbitral awards.

Combining a systematic analytical study of the texts and principles underlying investment law with a jurisprudential analysis of the case law arising in international tribunals, this book offers an ideal introduction to the principles of international investment law and arbitration, for students, scholars, and practitioners alike.

Key highlights:

  • Provides a unique overview of the principles shaping the international law of foreign investment, as they have been defined in investment treaties and by the jurisprudence of international tribunals

  • Includes a specific chapter on procedure and tactics

  • Contains a part on China, an infrequent participant but its investors will certainly have an increasing need to resort to investor state arbitration
