This Special Supplement to the 9th edition of Benjamin’s Sale of Goods is dedicated to the Consumer Rights Act 2015. It deals with those parts of the Act that concern sale of goods contracts, though incidental references are made to related contracts such as hire purchase and services contracts.

The 2015 Act is a major statute that largely consolidates existing primary and secondary legislation in the field of consumer sales and related transactions. Its principal effect on the present law is as follows:

  • In the Sale of Goods Act 1979, it repeals special provisions that apply only to consumer sales, notably s.14(2)(D)-(F) and Part 5A, and carries them over into the new Act.
  • It repeals the Unfair Terms in Consumer Contracts Regulations 1999.
  • In the Unfair Contract Terms Act 1977, it repeals those provisions that apply only to contracts where one party deals as a consumer and largely carries them over into the new Act.
  • It disapplies the Sale of Goods Act in so far as this Act confers rights on consumer buyers and carries the relevant provisions over into the new Act.
