The 2004 Act is the first major reform of planning law for over 10 years.

This book sets the Act and its supporting regulations in context in order to ensure a thorough understanding of its implications.

Major proposals contained in the Act include:

  • changes to development control, including a reduction of the time in which planning permission consent can be implemented, a new definition of development to incorporate mezzanine floors, and various provisions to end the ability for developers to 'twin track' applications
  • the current system of unitary, local and structure development plans is to be replaced by regional spatial strategies and local development documents prepared by LPAs
  • changes to the basis on which a local authority may acquire land compulsorily for the purposes of regeneration and major urban development projects
  • regional planning bodies and LPAs will have a statutory duty to contribute to the achievement of sustainable development
  • the Crown will no longer be immune from planning control.
